In a July 7, 2017 article, investigative news organization ProPublica reported on an internal memo directing I.C.E officers to arrest all undocumented immigrants encountered regardless of criminal history. This is a stark departure from previous federal policy of prioritizing actions against undocumented residents that pose a public safety risk
The new inhumane and indiscriminate policy has led to increased arrests of non-criminal immigrants across the country.
“In recent months, the number of undocumented immigrants arrested who are considered to be non-criminals has risen. (Under the law, merely being here illegally is not a crime. Rather, it’s a civil violation.) Between February and May, the Trump administration arrested, on average, 108 undocumented immigrants a day with no criminal record, an uptick of some 150 percent from the same time period a year ago.”

Immigrants caught-up in the new directive are not provided a court appointed attorney, because simply being in the United States without documentation is a civil offense.
